OKLAHOMA: Retired Bishop May Face Trial For Crossing Diocesan Boundaries

An 86-year old retired orthodox Bishop of The Episcopal Church could face a trial for violating the Constitutions and Canons of the TEC for ministering in a geographic area without permission of the local diocesan bishop.

Bishop William J. Cox has served as Bishop Suffragan of Maryland (1972 to 1980), Assistant Bishop of Oklahoma, (1980-1988). He also served as assistant bishop to Bishop Ben Benitez (Texas) and later with Bishop Claude E. Payne when he became diocesan bishop. He also served as a parish priest at St. Matthew's in Austin, Texas.

Two revisionist bishops, Dean Wolfe of Kansas and Robert Moody of Oklahoma, who felt threatened by the bishops actions, sent presentment charges in the summer of 2005 to the then Presiding Bishop Frank Griswold with documents alleging Cox had committed canonical violations. He ordained two priests who were part of an Episcopal congregation, Christ Church, in the Diocese of Kansas which left the diocese and ECUSA after agreeing to pay the bishop and diocese $1 million over the next ten years as part of a separation agreement.

The charges against Bishop Cox were forwarded to the Title IV Review Committee, for disciplinary action. Now, two years later, having completed its investigation, the committee has determined that there were sufficient grounds to go to trial.

"It's amazing," observed Anglo-Catholic editor Auburn Traycik, "that Bishop Griswold has time to ask for an investigation of the Cox case, but has no time, evidently, to move forward the presentment filed against Connecticut Bishop Andrew Smith, filed A YEAR AGO. Griswold is in blatant violation of the canons on that case, on which there should have been initial action last fall."

"I have not been notified, I have not received a presentment, but I gather from friends that the HOB meeting in Camp Allen, Texas has said I will face an ecclesiastical trial court because I confirmed and ordained two faithful priests in 2005," Bishop Cox told VOL by phone.

The bishop mused that it was ironic that the Episcopal Church never saw fit to bring to trial Newark Bishop John Spong for his heresies, "but they want to go after an old bishop who wants only to remain faithful to the faith once delivered."

Asked where they would hold his trial, Bishop Cox said he didn't know. "I haven't been notified but I am sure it has happened. The Pony Express has not arrived."

Asked why it has taken several years for this to come to a head, Cox replied, "the process does move slowly. My attorney said it could take several months."

Cox is not denying the charges. "We admitted that I had confirmed and ordained two priests and a deacon at Christ Church in Overland Park, Kansas in June 2005, after I was asked too by the Primate of Uganda, the Most Rev. Henry Luke Orombi. I returned a month later and led a service of confirmation at Christ Church."

"There is no point in arguing whether I did it intentionally, I did. This was not a matter of geographical boundaries but a matter of jurisdiction. The Archbishops of Uganda and the Southern Cone (Most Rev. Gregory Venables) both had jurisdiction over the congregations I visited."

"Doesn't it seem strange to you to be bound up in court legalisms for people outside the Episcopal pale. It has become uncharitable...we are supposed to be Christians. If I wanted to minister at a Methodist church why should I have to go to the bishop and ask his/her permission. They never came after Spong for his heresies. The truth is this is not a a question of the violation of the faith but a question of geographic jurisdictions and pure legalism. It is about process not the faith."

"I am 86, and they are trying to hound me into the grave, but I am going to outlive them," he said with a chuckle.

"If I am found guilty they can't put me in jail, they can't strip me of my bishopric; orders are for life. All they can do is prohibit me from ministering in The Episcopal Church. The real and deeper question is, who is going to be left to minister to faithful orthodox believing Episcopalians in the coming months and years?"

The bishop said that retired bishops can no longer minister to people without the permission of the sitting diocesan bishop. "That is too much. The House of Bishops needs to look at that. We should be able to minister to the needs of orthodox folk with the authority of the Primates."

He lives with his wife, Betty, in Tulsa. She is 85.

Long life to the Bishop! And may he keep on ministering to the faithful who seek his ministry, regardless.

After breaking all the important rules--you know, creeds, commandments, such like--now TEC is going after trespassing.

Well, to enforce that you need to post signs every few feet. So let's get rid of those quaint and obsolete "The Episcopal Church Welcomes You" placards--takes you back, doesn't it, to better and simpler times? And replace them with legal warnings on every fencepost and telephone pole and tree in the perimeter around the church, giving procedures for obtaining access. Reminds me of Checkpoint Charlie!

If the good and godly Bishop Cox ordained two priests into the Province of Uganda, I don't see how Title IV applies. Perhaps Messrs Wolfe and Moody should bring presentment charges against ++Orombi. I'm sure KJS, with her influence on the Primate's Standing Committee, could arrange such.

Good grief. Have they nothing else to do? JotM's observation is quite appropriate.

That's the spirit in the face of persecution! This story is simply more evidence that TEC really isn't interested in inclusivity, they just want to include who they want to include. How 'bigoted', to use their own words against them.

It's a sad world we live in when people have to pick on 86 year old bishops! I think that should be construed as elder abuse! The bishop should call AARP and get them on his side. That could be a good show down - TEC vs AARP.

TEC is coming unglued: they are at odds with the rest of the Anglican Communion, the money isn't coming in, Church membership is at a low and falling, parishes, including the largest (Christ Church Plano) as well as George Washington's former parish in Virginia are leaving, and what does the Church do? They pick on an 86 year old Righteous Servant of our Lord.

Wolfe and Moody should be ashamed of themselves.

May TEC burn in Hell for this! I know Bishop Cox, and he is considered by most who do know him to be a living Saint. A more righteous and Godly man (and wife) do not exist! He is one of those people who can palpably change the atmosphere in a room just by walking into it. For the perverted leadership of TEC to attack this faithful servant of the Lord, while doing nothing at all to the heretical likes of Pike, Righter, Bennison and Spong (to name but a few) is an insult to our intelligence and a travesty of justice. Wasn't the Soviet Union (in)famous for this sort of boldly evil behavior?

May God bless and protect Bishop and Mrs. Cox!!!



P.S. Moody is the one who thought it was just a grand idea to ordain as deacon a known male transvestite, who then proceeded to use money he had kept hidden from his wife and children to go to Thailand for a sex change operation...with no subsequent criticism from Moody...

I like your trespassing observation Unitarian, but I'lll go a step further. It's like vandals broke into your house, stole all the silver and jewelry and set the house and fire. Then, when caught, the vandals are treated to a barbeque by the police and the firefighters are charged with trespassing.

My wife and I left Tulsa, OK almost 5 years ago (having lived there for 18 years) for Santa Fe, NM and knew Bishops Cox and Moody. What a breath of fresh air the Diocese of Rio Grande is from Oklahoma. +Cox is one of the finest individuals we have ever met and has more integrity than Moody could/can ever dream of. So, Moody decides to proceed with this totally inexcusable attack on +Cox and at the same time announces he will retire this year. How convenient. He can then take no further responsibilty officially for his deeds w/r/t +Cox and for his pushing the Diocese of OK away from Anglicanism as one of the most revisionist bishops known. But, he won't stick around to see either of them through. He has had his eyes set on the Church Pension Fund for too long apparently and can read the writing on the wall about the demise of TEC as part of the Anglican Communion. What a "CYA" on his part-getting out while the "gettin's good". Shameful, but predictable and not a surprise knowing how he operated all along.

Has anyone being paying any real attention to the recent battles in the Episcopal Church USA (ECUSA)? What has happened to the teachings of morals and ethics in the Scriptures and the respect of the apostolic ministry? The Episcopal Church USA is doing battle over its recent moral crisis of ordaining a bishop in New Hampshire that is an openly professed fornicator, divorcee and is currently in a relationship with another man. Some of their priests have gone so far as to advocate abortion, pre-marital sex and parenting outside of marriage. Laity across the U.S. are seeking pastoral care from anywhere they can get it. Recently, the Episcopal Bishop of Oklahoma Robert Moody, who voted for the Bishop in New Hampshire, has become quite concerned over the matter of two retired bishops from Oklahoma that broke ranks and went up to Ohio with other rogue Bishops to perform the Sacrament of Confirmation (affirmation of their faith) without the Ohio Bishop’s permission.

In Moody’s recent message on the diocese Web site, he has taken issue with the fact that these Bishops were not licensed to lay hands on members of the church in Ohio. In particular, he stated that retired Bishop William Cox’s and Bishop William Wantland’s “decision to participate in an event that has created a constitutional and canonical crisis” was a surprise to him. The House of Bishops of ECUSA are to meet later in March and Moody stated their meeting would likely result in a “response that could be a censure of these bishops or a presentment that could lead to an ecclesiastical trial.” It seems odd to me that a pastoral messenger must now become overwrought with concern of legalities and canons within the church. Did Jesus and the apostles have to deal with any canons in their time? Would they be “creating a constitutional and canonical crisis” today if they were to go to Ohio to minister the Word and lay hands on the believers? I applaud the fact that the laity and those retired Bishops took their roles as Christians seriously, followed the teachings of Christ and the Scriptures and fired the canons.

Whoa there, Ikerliker. The AARP is as liberal as TEC. AARP has been taken over by the same kind of rabble as TEC. I am no longer a member of TEC and have never been a member of AARP.

If the Parish +Cox ordained and confirmed in was under the jurisdiction of Uganda and he did so after being asked by the Primate of Uganda, where does TEC get off thinking that their canons apply to the situation. He was NOT functioning in another TEC Diocese but in a parish of another jurisdiction. What next, as a Continuing Anglican Priest are they going to try me for officiating at services in the local Diocese without the good Bishop's permission? Good grief. "From all false doctrine, heresy, and schism; from hardness of heart, and contempt of thy Word and commandments. Good Lord, deliver us."

May God stand with Bishop Cox. Would that TEC had more Bishops like him.

I have known +Cox since 1983 when I was confirmed by him. I have known +Moody since the late 80's, meeting him for the first time when he came to OK to campaign for the episcopate. Moody is a not exactly the pragon of humility, but an autocrat. He is in the final lap of his episcopate, and it would be useful to see an audit of his impact on the diocese. ASA? Average Sunday attendance is way off, but that is not out of line with the rest of TEC. How many parishes were planted during his time here? I may be mistaken, but I think the answer is 'one'. He would blame the soil I am sure, but the answer is rotten seed seldom bears fruit. Finances are way off, and +Moody and the Standing Committee complain that restrictions on endowments preclude them from carrying out effective ministry because their hands are tied. +Moody's episcopate will be described as dull, less than average, less than remarkable, etc. He lost 2 complete parishes who bolted to practice the faith once delivered. A third, Holy Cross in Owasso, saw the rector and the majority of the communicants move as well. HC continues to exist, but greatly impaired by the lack of communicants.

To those who have been given much, much shall be required. If +Moody is anticipating the greeting "Well done my good and faithful servant," he needs to reflect further. The record is clear; his time in Oklahoma is bereft of fruit. He came. He saw. He floundered. If upon departure, the greatest work he claims is that he put a whooping on a 86 year old +Cox, it speaks for itself.

As for Moody (a truly appropriate name) may God's just will be done.
